probate administration

we offer expert representation

Probate is the process of settling an individual’s estate after their death with court-supervised administration. Whether the individual has died with a will or Intestate (without a will), the court will appoint a personal representative (or executor) to carry out the administration. The probate process can be time-consuming and very detail-oriented. Navigating the court process alone is not for the faint of heart.

Holmquest Tax & Trust has vast experience representing and serving as personal representative in probating the simplest to the most complex estates. We will guide the personal representative through the process of taking inventory of assets and property, establishing the estate with the IRS, paying creditors and funeral expenses, filing personal and estate tax returns, and making distributions to beneficiaries.

We have experience administering the process for clients with property and assets across the United States and internationally, including:

  • Informal probate.

  • Pour-over wills to a trust.

  • Multi-state probates.

  • Dual citizenship.

  • Foreign-owned property.

  • Apostille requirements and certified translations.

  • Unique assets, rare coins, and works of art.

  • Generation-skipping and disclaiming of inheritance strategies.

  • Intestate laws of distribution to heirs.

  • When to and when not to maximize the unlimited marital deduction.
